JA/GG DOE 146 v. THE ROMAN CATHOLIC ARCHDIOCESE OF NEWARK, et al.,
May 4, 2022
Superior Court of New Jersey - Essex Cty. Law Div.
ESX-L-007889-21

CHILD USA filed this brief in supporting Plaintiff’s Opposition to the Defendant’s Motion to Dismiss. The Defendant claims the revival provisions of the New Jersey Child Victims Act are unconstitutional and offend the Defendant’s due process rights, as applied. CHILD USA argues that New Jersey courts have long allowed revival of civil claims, even where there is an inconvenience to a defendant, and that New Jersey’s interests in providing access to justice for victims who missed arbitrary statute of limitations deadlines outweighs any interest a defendant has to not be sued.
