CRIMINAL SOL HISTORY

 

 

Age Cap

By 2007

Costa Rica Congress approved Law 8590/2007 to strengthen the fight against child sexual exploitation. It amended art 31 of Costa Rica’s Criminal Procedure Code amending paragraph a. It established that in sex crimes against children the 10 year criminal statute of limitations would be suspended until victim reached age of majority.

2009

Costa Rica Congress approved Law 9685/2019. Law on the Right to Time, reform of the Criminal Code to extend the statute of limitations for criminal action in cases of sexual crimes against minors or persons without volitional or cognitive capacity. It only had one article that amended article 31 of Costa Rica’s Criminal Procedure code adding paragraph c. Criminal statute of limitations for child sex abuse expires 25 years after the victim reached the age of majority (when victim turns 43 years old). It extended the criminal statute of limitations from 10 years up to 25 years after victim reaches age of majority.

Current COSTA RICA criminal law:

ARTICLE 31.“Statute of limitations of criminal action”.

If the criminal prosecution has not been initiated, the action will expire:
a. After a period equal to the maximum sentence has elapsed, in crimes punishable by
imprisonment; It may not exceed ten years nor be less than three, except in sexual
crimes committed* against minors, in which the statute of limitations will begin to run
after the victim has reached the age of majority.
b. After two years, in crimes punishable only with non-custodial sentences and in
misdemeanors or misdemeanors, except in crimes committed by legal persons, in which
the prescription will be ten years.
c Twenty-five years after the victim reached the age of majority, in the case of sexual
crimes* committed against minors or persons without volitional or cognitive capacity.
The above rule shall apply indistinctly to any perpetrator, accomplice, or participant
responsible for the respective punishable act, provided that at the time of committing
the crime they have acquired the majority.

* Important note: Book II. Title III (art 156 to 175 quinquies) of the Costa Rican, Criminal
Code is titled “sexual crimes”. Thus, the extended criminal SOL is regulated in art 31. c of
the Costa Rican Code of Criminal procedure applies to art 156 to 175 quinquies when
victims are children &lt; 18 years old.

Other legislation

Law 9685/2019. Right to time Law: Addition of subsection c) to article 31 of law no 7594,
criminal procedural code, of April 1 of 1996, to extend the limitation period of criminal
action in cases of sexual crimes against minors or persons without volitive or cognitive
capacity.
