BRIEF OF AMICUS CURIAE re. RIA WILLIAMS v. KINGDOM HALL OF JEHOVAH’S WITNESSES, ROY, UTAH
May 22, 2019
SUPREME COURT OF UTAH
-

This amicus brief was written to request a ruling by the Supreme Court of Utah after a lower court found that the First Amendment immunizes religious institutions from liability for tortious claims arising from a religiously-motivated sexual assault investigation. CHILD USA examined the ways in which harassing interviews of rape victims can further traumatize the victim, and how that harassment reasonably results in claims that courts should review, like intentional infliction of emotional distress. The final opinion is Williams v. Kingdom Hall of Jehovah’s Witnesses, Roy, Utah, 2021 UT 8 (Utah 2021).
