In this brief, CHILD USA urges the Ninth Circuit to revive a class action lawsuit against the website Reddit for facilitating and profiting from child pornography posted on their platform after a court determined that Reddit was immune from liability under Section 230 of the Communications Decency Act (CDA). CHILD USA argues that the case fits squarely into the language of a provision of the Trafficking Victims Protection Reauthorization Act (TVPRA) that allows victims to bring a civil claim against a third-party that knowingly profits from their trafficking. Reddit has repeatedly been notified of illegal content on its platform and not only failed to remove it but also profited from its proliferation on their platform and must be held appropriately accountable.
