CRIMINAL SOL HISTORY

 

Age Cap

By 2005

In February 2005 Andorra enacted Law 9/2005, the new Criminal Code. Article 82 of
the new Criminal Code established that in sexual assaults and crimes against minors,
from when the victim turns 18 years of age or after his death if he has not reached the
age of majority. In the previous Criminal Code from 1990 there was no special
criminal statute of limitations rule for sex crimes against children.

Current Andorran criminal law:

Article 81

The limitation period of the criminal action.
The limitation period of the criminal action extinguishes the criminal responsibility of the
accused after the following terms:
Thirty years for crimes that have been assigned a penalty of the maximum limit of which is ten
years or older.

Ten years for the other major crimes.
Four years for minor crimes (penalty up to 2 years of custodial sentence).
Six months for the crimes of slander, insult and defamation and for fines.
The criminal action for the prosecution of genocide and crimes against humanity does not
prescribed in no case.

Article 82

Computation of the statute of limitations
The limitation period begins to count from the day it ceases the punishable action or omission.
However, in consummated crimes, the calculation is verified from the moment the result is
obtained, and in sexual assaults and crimes against minors, from when the victim turns 18 years
of age or after his death if he has not reached the age of majority In case of continued
infringement, the term is calculated from the day on which it was committed the last offense.
