Summary: There is a statute of limitations for all crimes. The statute of limitations varies from 3 (2 *24) to 20 years depending on the crime and the aggravating circumstances. Criminal SOL is based on the maximum custodial sentence and is subject to intervening periods (e.g., the clock starts ticking from zero after a Judge accepts a complaint and is reset again after a first level award, etc.). After sentencing, criminal SOL is determined by the effective sentence, so if a crime is punishable with 3 to 6 years (originally subject to a 12-year SOL) but the defendant is sentenced to 3 years, SOL will be 8 years. The new SOL applies retroactively with regard to each pertinent interlude during a criminal prosecution (e.g., between the acceptance of a complaint and the issuance of the first level award), except with regard to the time elapsed between the date of the crime and the first interruption (acceptance of a complaint).

Certain characteristics of the accused also affect the SOL as it will be halved for defendants aged (a) 21 or under at the time of the offense or (b) 70 or older at the time of sentencing (Art. 115 Brz.Pen.Code).

Law 11.829 (November 2008) which modifies Law 8069 (June 1990). Statute of the
child and adolescent, to improve the fight against the production, sale and distribution
of child pornography, as well as criminalize the acquisition and possession of such
material and other conduct related to child sex abuse on the internet.

2012

In May 2012 the Brazilian Congress approved Law 12650/2012. This law had only
one article that modified Art 111 of the Brazilian Penal Code. In sex crimes against
children included in the Penal Code* or special legislation** the criminal statute of
limitations was suspended (tolled) until the victim turned 18 years old, unless
criminal action had already started at an earlier

2022

In May 2022 the Brazilian Congress approved Law 14344/2022. Article 31 of this
law modified art 111 of the Brazilian Penal Code. In addition to sex crimes against
children included in the penal code* or special legislation**, the criminal statute of
limitations was also tolled until the victim turned 18 years old in crimes in violent
crimes against children and adolescents.

*Concordat: Signed 13 November 2008, ratified 7 October 2009. The Concordat makes it
impossible to sue the Church for the damage they cause, since this concordat states that they are
not employees. (Art. 16.1)
Article 16.1:
“Given the peculiar religious and charitable character of the Catholic Church and its institutions:
I – The relationship between the ordained ministers or believers consecrated by vows and
the Dioceses and Religious Institutes or equivalent is of religious nature and therefore, in
accordance with the Brazilian labor legislation, does not generate by itself, an employer-
employee bond, unless a distortion of the ecclesiastical institution is proven.”

ARTICLE 109

The criminal statute of limitations, before the final judgment becomes final, except as provided
in § 1 of art. 110 of this Code, is regulated by the maximum penalty of deprivation of liberty
assigned to the crime, running out:

I – in twenty years, if the maximum penalty is greater than twelve;
II – in sixteen years, if the maximum penalty is greater than eight years and does not exceed
twelve;
III – in twelve years, if the maximum sentence is greater than four years and does not exceed
eight;

IV – in eight years, if the maximum sentence is greater than two years and does not exceed four;
V – in four years, if the maximum sentence is equal to one year or, if it is greater, it does not
exceed two;
VI – in 3 (three) years, if the maximum penalty is less than 1 (one) year.
ARTICLE 111
The criminal statute of limitations, before the final judgment becomes final, begins to run:
I – the day the crime was committed;
II – in case of attempt, from the day the criminal activity ceased;
III – in permanent crimes, from the day the permanence ceased;
IV – in bigamy and in the falsification or alteration of the registration of the civil registry, from
the date on which the fact was known.
V – in crimes against sexual dignity* or that involve violence against children and adolescents,
provided for in this Code or in special legislation, from the date on which the victim turns 18
(eighteen) years old, unless, at that time, the action has already started.

ARTICLE 115

The statute of limitations is reduced by half if the offender was, at the time of the offense, under
21 (twenty-one) years old, or, at the time of sentencing, over 70 (seventy) years old.

ARTICLE 117

The course of prescription is interrupted:
I – upon receipt of the complaint or complaint;
II- by pronunciation;
III- by the decision confirming the accusation;
IV – by the publication of the judgment or appealed judgment;
V- for the beginning or continuation of the execution of the sentence;
VI – by recidivism*.

Paragraph 1 – Except in the cases of subsections V and VI of this article, the interruption of the
prescription occurs with respect to all the perpetrators of the crime. In related crimes, which are
subject to the same process, the interruption related to any of them is extended to the others.
Paragraph 2 – Once the prescription is interrupted, except in the case of item V of this article, the
entire term begins to run, again, from the day of the interruption.

*Important: In Brazil SOL is interrupted if the perpetrator commits a new sexual crime.
